Chipping Campden War Memorial Green The Chipping Campden War Memorial Green is a community space owned and managed by the Chipping Campden Town Trust Charity. Now that the post COVID government legislation relaxing many ‘rules’, to encourage a return to business as usual, has been withdrawn, there must also be a return to full legislative oversight. In order for a trader to lawfully occupy and sell products and services on the Green, the Trust and trader must satisfy the legal requirements of both the Charity Commission and the local planning and alcohol licencing authority.In an act of goodwill earlier this year, the Town Trust agreed to the continuation of an arrangement with a local restaurant first entered into when post COVID recovery was the Government’s top priority. That agreement has had to be rescinded because advice from Cotswold District Council and the Charity Commission suggest it might not be fully lawful. We have been advised that a trader seeking to trade for more than 28 days per annum on the Green must obtain planning permission for temporary change of use from community space to commercial, while the planning authority’s relaxation of alcohol licence conditions is valid only until the end of September. The arrangement with the trader must also meet the Charity Commission’s regulations that local planning and licencing requirements have been met, and in addition the Trust must be able to demonstrate that the rental payments provide the Trust with a fair and best value return. A Chartered Surveyor or similar professional would be needed to provide this. As custodians of the Green, the Trustees have therefore had to withdraw the agreement from earlier this year while awaiting further advice. The Trustees Chipping Campden Town Trust
